Supreme Court may take up the issue of marriage equality

The United States Supreme Court will decide this week whether to hear appeals from advocates of California’s Proposition 8, the 2008 ballot initiative that limited marriage to one man and one woman.

If the Court agrees to hear the case, it will decide whether states can protect the rights of gays and lesbians to marry.

Proposition 8 was struck down by a federal judge who ruled it violated the state constitution’s guarantee of equal protection under the law, a ruling upheld by a 2-1 vote of the U.S. 9th Circuit Court of Appeals.

While it appears a majority of justices may be interested in hearing an appeal it does not appear a majority would rule to overturn it, clouding the possibility of the Court taking up the case.

Like most Americans, Libertarians believe government should not define, regulate, license or tax marriage, leaving it up to people, businesses and other parties who to treat as married couples.
